I suppose it’s possible that this isn’t the biggest news to come out of the U.S. Supreme Court today – I seem to remember they are up to something else this week… but in the orders issued today, they declined to take up the case of Nampa Classical Academy. Nampa was a charter school in Idaho that requested to use the Bible as central part of its primary source curriculum. When the state denied that request, Nampa filed suit, arguing that the denial amounted to a violation of religious freedom rights. The 9th Circuit eventually upheld a trial court’s ruling in favor of the Charter School Commission’s decision, prompting Nampa’s appeal to the U.S. Supreme Court.
Today’s denial by the Court leaves that appellate ruling in place, allowing states to limit the use of religious text in the curriculum.
