Written by Don ByrdAn editorial in the University of Wisconsin-Madison’s Badger Herald argues the state’s proposed Religious Freedom Amendment – a state version of the Religious Freedom Restoration Act – would disrupt the balance of religious freedom protections already in place. Quoting the Baptist Joint Committee’s Nan Futrell commenting on a state RFRA proposal similar to Wisconsin’s, law student Aaron Loudenslager warns that the Wisconsin threshold for claims under the amendment may be too permissive.
Written by Don ByrdA federal judge in Hawaii has ruled the Religious Freedom Restoration Act applies to protect a minister charged with distributing marijuana to parishioners. Reverend Roger Christie argues the use of cannabis is an expression of his religion that because of RFRA may not be substantially burdened by the government without a compelling government interest narrowly tailored. The judge in her ruling last week allowed the trial to go forward with Christie able to use that defense.

The Third Circuit, affirming the trial court’s refusal to bar enforcement of the mandate against Conestoga Wood Specialties Corporation, has ruled that a for-profit, secular corporation like Conestoga cannot exercise religion, and thus is not covered by the Religious Freedom Restoration Act.
