In a statement following yesterday's Supreme Court decision rejecting taxpayers' right to sue Arizona over the constitutionality of its tuition tax credit scheme, the Baptist Joint Committee expressed its concerns.
“This is a disappointing decision,” said BJC General Counsel K. Hollyn Hollman. “A state legislature should not be able to avoid a legal challenge by simply using an alternative tax mechanism. That denies citizens the right to fight for strong protections against a governmental establishment of religion.”
The BJC filed a brief in the case, focusing specifically on the issue of standing, arguing that above all the challenge should be allowed.
